Article 1 – Scope
These terms apply to all contracts between TREX IPTV (WhatsApp: +491632476855, Telegram: @t_rextv; “provider”, “we”) and customers via the website trex-tv.nl. Deviating terms of the customer do not apply. A consumer is any natural person not acting in the course of a trade, business or profession.
Article 2 – Subject of the contract
For the chosen term we grant the customer personal access to live TV, movies and series (“service”). Scope and features follow from the plan description at the time of ordering. The channel line-up may change; we announce significant restrictions in good time. The access may be used on 1 device(s) at a time.
Article 3 – Conclusion of contract (ordering via WhatsApp)
Showing the plans on the website is not a binding offer. Via the order page, the customer sends an order request via WhatsApp. In the WhatsApp chat we share the plan, total price, payment methods, these terms and the information on the right of withdrawal. The contract is concluded when the customer expressly confirms the order with an obligation to pay in the chat and we accept the order – at the latest by providing the login details. The customer receives the contract confirmation in the WhatsApp chat. The contract language is Dutch.
Article 4 – Prices and payment
The prices shown on the website at the time of ordering apply. Payment is made once before access is provided, using the payment methods named in the chat (PayPal or another method by arrangement).
Article 5 – Term – no automatic renewal
The contract runs for the chosen fixed term and ends automatically without notice. There is no automatic renewal. A renewal only takes place through a new, active order by the customer.
Article 6 – Free trial
We offer a free trial of 24 hours, requested and provided via WhatsApp. It is limited to one trial per person, email address and WhatsApp number, ends automatically and does not create any payment obligation. There is no entitlement to a trial.
Article 7 – Customer obligations
- The access is for private use only.
- Login details must be kept secret and may not be passed on or resold to third parties.
- Public screenings as well as recording and redistributing content are prohibited.
- In case of serious violations we may block access after a warning, in serious cases immediately. The customer’s statutory rights remain unaffected.
Article 8 – Availability
We strive for availability with as few interruptions as possible. Temporary restrictions due to maintenance, security measures or disruptions beyond our control are possible. We are not responsible for the customer’s internet connection or devices.
Article 9 – Third-party apps
Recommended player apps (e.g. IBO Player, TiviMate) are third-party products. Their respective providers are responsible for their function, availability, cost and privacy.
Article 10 – Conformity
Statutory rules apply, in particular the provisions on digital content and digital services in Book 7 of the Dutch Civil Code.
Article 11 – Liability
We are liable without limitation for intent and deliberate recklessness and for damage resulting from death or personal injury. In other cases our liability is limited to the amount paid by the customer for the relevant term, insofar as permitted by law.
Article 12 – Right of withdrawal
Consumers have a statutory right of withdrawal. Details are set out in the information on the right of withdrawal.
Article 13 – Referral programme and resellers
The conditions on the “Refer” page apply to the referral programme. Reseller contracts are concluded separately.
Article 14 – Disputes
You can submit complaints to us via WhatsApp or Telegram; we respond as quickly as possible. We are neither obliged nor willing to participate in dispute resolution before a disputes committee.
Article 15 – Final provisions
Dutch law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection of mandatory provisions of the country of their habitual residence. If individual provisions are invalid, the remaining provisions remain in force.
